“Don’t worry about probate—if you’re married, everything automatically goes to your spouse anyway!”

While this might sound reassuring, it’s not entirely true in Florida. The best way to be sure that your assets transfer to who you want, is through executing an estate plan with legal representation. How your assets are owned determine how your assets pass at your death.

Probate Corner…

In Florida, if a person passes away without a will (intestate), the probate court follows a specific order of distribution based on state law. For example, if the deceased individual was married with no children from a previous relationship, the surviving spouse inherits everything—but if there are children from another relationship, the spouse only receives half of the probate estate, with the remaining half going to the children of the deceased individual. Remember, this is only applicable to probate assets. Check out our YouTube Channel to learn more about probate assets. This is why it is important for blended families to have an estate plan established.
