Probate Corner…

Being named as a Personal Representative in someone’s Will does not automatically authorize you to act in that role. Instead, it serves as a nomination. You are not obligated to accept the role and can decline for any reason.

To legally serve as a Personal Representative, you must be formally appointed by a Judge during a probate proceeding. Only after this appointment can you take legal actions on behalf of the estate, such as opening an estate bank account, filing lawsuits, or negotiating with creditors.

However, probate is not always required. Many tasks, like dividing personal property or transferring a vehicle title, can often be done without probate. Similarly, assets with named beneficiaries, like life insurance or retirement accounts, are distributed directly by the financial institution. Filing a final tax return is usually the responsibility of the person managing the estate but does not always require court appointment.

My Neighbor Said…

My neighbor said a DNR is the same thing as a living will.

These two documents are very different. A DNR (Do Not Resuscitate) is an Order that must be signed by a physician. A living will does not get signed by a physician. The DNR is referring to resuscitation, where as the living will is dealing with life prolonging procedures through artificial means. Do you want CPR if have a heart attack? If your answer is yes, then perhaps a DNR is not the document for you. We are not medical professionals – please ask your doctor if a DNR is right for you.
