Probate 101

Probate is the court process that transfers an asset out of a deceased person’s name into a beneficiary’s name. Any asset (such as financial accounts and Real Property) in a deceased person’s name alone with no beneficiary designated will go through probate. Here at Pittman Law, we help clients reduce the assets that would need to pass through probate, whether it be through beneficiary designations on financial accounts or creating a Revocable Living Trust.

A lot of our clients have heard horror stories about probate and yes, some of them are true. However, every probate is different and it doesn’t have to be terrible process. The probate process varies based on the type of asset going through the probate process, the value of the asset, if there are a lot of creditors, and who the beneficiaries are. The more assets that go through probate, the more costly and time consuming the process can be.

More often than not, family dynamics play a big role in whether disputes arise. This is particularly true for blended families, where biological children have different expectations than their stepparent and step-siblings. Some disputes can be avoided when you have proper beneficiary designations or assets are titled correctly.
