Merry Christmas!

As we enter the Christmas season, now is a good time to think about how and what you need to tell your friends and family about your estate plan. Do you need to make sure they know where you keep your estate planning documents? Do they need to know about your assets? How much do they really need to know? We recommend you tell your administrators that they are:

  1. In charge – whether it be of medical decisions, financial decisions or both;
  2. Where to find your estate planning documents; and
  3. Who the attorney is that created your estate plan.

Some things to clarify… Who are your administrators? Administrators are the people you have chosen to be in charge of your medical decisions and your financial decisions. Remember, the medical administrators, also known as your Health Care Surrogate and financial administrator can be your Financial Power of Attorney agents, Successor Trustee or Personal Representative do not have to be the same people and they do not have to be the beneficiaries of your estate plan. Also, we do not recommend that your keep your estate planning documents in a safe deposit box because it could delay your administrator from getting the documents. Keep your documents in a safe place in your home. If you keep them in a safe, don’t forget to tell your administrators how to get into the safe.
