A common (and often surprising) fact about Florida probate is:
⚖️ Even if you have a will, your estate still has to go through probate in Florida.
Many people think having a will means their estate automatically avoids court—but in Florida, that’s not the case. A will simply tells the probate court how you want your probate assets distributed. The estate still goes through the probate process unless you’ve taken additional steps like creating a revocable living trust or using beneficiary designations and joint ownership to pass assets outside of probate. My Neighbor Said…
People often tuck their will or trust documents away in a locked safe, safe deposit box, or an obscure drawer—and then forget to tell their family, executor, or trustee how to access them. If no one can find the documents when needed, it’s as if they don’t exist at all.
Pro Tip: After your plan is finalized, let at least one trusted person know where your estate planning documents are stored and how to access them as well as how to get in touch with us. A great estate plan only works if it can be found!
