Let’s talk about titling assets

It is critical to title assets correctly to ensure that they follow the estate plan that you have created. If your main estate planning document is a Last Will and Testament, you need to make sure that all of your financial assets have beneficiaries listed. The type of account will determine what the beneficiary designation is called, sometimes called Pay on Death Accounts (POD) or Transfer on Death Accounts (TOD). Listing people on these accounts will ensure that your money does not go through probate.

If your main estate planning document is a Revocable Trust, the way you title your assets will depend on: (1) the age of your beneficiaries, (2) how you control the money after you pass away, and (3) what type of accounts you have.

If you are a current client of Pittman Law Office and you aren’t sure if your assets are titled correctly, consider attending our Coffee with Counsel on March 9, 2022 with Attorney Audra M. Platt. See details below.

Helpful Tip: Have you ever heard the term per stirpes? This term is Latin, and it means that if the person you have listed as a beneficiary passes away, then you want their share to go to their descendants. You will usually see this term when you fill out your beneficiary form for a retirement account (IRA, 401K, 403B).

If you are a current client and are unable to attend our Coffee with Counsel, and you have questions concerning the titling of your assets, call the office at 352-399-6944 to schedule a phone call with your Attorney or you can email your attorney directly.
