As summer settles in here in Florida, we’re reminded of all the reasons we love calling Florida home—sunny mornings, coastal breezes, and time well spent with family and friends. For many of our clients, this season brings well-deserved relaxation, travel, and perhaps even time with grandkids. It’s also the perfect time to revisit something just as important: your estate plan.

The #1 Mistake We See: Thinking You’re “All Set”

One of the most common (and avoidable!) estate planning mistakes we see is assuming your plan never needs to be updated. In reality, life happens—families grow, laws evolve, and your goals may shift. We recommend reviewing your estate plan every 3–5 years, or sooner if you’ve experienced:

  • A move to a new state (especially to Florida!)
  • A change in marital status
  • Selling or purchasing property
  • Health issues or changes in long-term care planning

Even if nothing has changed, we’re always happy to review your plan and make sure it still meets your needs and wishes. If you are a current client, email the attorney who helped you with your estate plan if any changes have occurred in your life.

Probate Corner…

In Florida, a personal representative (also known as an executor) must be either a Florida resident or a relative of the person who passed away—such as a spouse, sibling, parent, child, niece, nephew or cousin or other family members —regardless of where they live. Non-relatives who live outside of Florida are not eligible to serve. Additionally, the personal representative must be at least 18 years old, mentally and physically able to perform the duties, and not have any felony convictions. Choosing the right person is important, as they’ll be responsible for managing the estate, paying debts, and distributing assets according to your wishes.

My Neighbor Said…

My neighbor said I could just download a will online and be done with it. Well, that’s like saying you can diagnose a heart condition with a Google search. Online estate plans might look convenient and cheap, but they often don’t follow Florida law, leave out critical documents, or create more problems than they solve. We’ve seen too many families stuck in court, dealing with expensive and painful consequences from DIY documents. Your legacy, your family, and your wishes deserve more than a fill-in-the-blank form.
