Probate Corner – What happens if someone dies without a will in the state of Florida? The short answer is that Florida law will dictate who gets your probate assets. For example, the Florida Intestacy Statues state that if you are not married, your children will inherit your probate assets. If you are married, your spouse will get all or a part of your probate assets, depending on whether or not you and your spouse have children together or separately. If you are not married and have no children, then your parents, and then siblings are your next legal heirs and so on. A Last Will and Testament is your chance to decide who gets your probate assets, how the probate assets are distributed, and who you want to be in charge of that process. No one knows your family better than you know them and no one is better to make decisions about your estate than you. |
