Probate Corner…

Each month, our office receives many calls from clients to notify us that his or her spouse has died. Certainly, this is an emotional and stressful time for the family. Most of the time, the person is frantic with worry that there is some legal task that he or she needs to do immediately. The first thing that we typically say is that there is nothing that needs to be done IMMEDIATELY from a legal standpoint. If you have an estate plan prepared by Pittman Law Office and you did your homework that the Attorney discussed with you, you are prepared. Our staff is here to walk you through your specific situation and answer any questions you may have. We have a Survivor’s Guide Checklist (which can be found on our website) that will give you an overview of issues that may arise when you lose a spouse. Pittman Law Office will be a resource to you when the need arises.

My Neighbor Said…

My neighbor said the only asset they have titled in their Revocable Trust is their real property. Of course, as attorneys we will have different recommendations. First, good job on titling your real property into the Trust. That is a big step in funding your trust properly and avoiding probate. However, most of our clients who prepare a Revocable Trust have the ease of administration in their minds when they choose to have a Revocable Trust based estate plan. Therefore, we would advise having at least one bank account titled in the Revocable Trust’s name. Most banks will allow this account to stay active after the Settlor/owner of the Revocable Trust dies. This money will be available for the Successor Trustee (person in charge when you die) to pay bills and handle the trust administration.
